I don’t know of a good lawyer in the lower Mainland, care to elaborate on your problems with CRA?

Send me an email.

from my cheque each payday?
It is a very small company, 3 employees and they hardly have any customers.

The government will eventually catch up with the employer if he is not submitting the deductions. There will be an audit and he will be ordered to pay the money within a certain amount of time. You will also have a record on your paystub the amount of money that has been deducted. Call Revenue Canada if you are not sure that the money is being paid to the government.

Do I have to produce bank statements and credit card statements for a PERSONAL audit? Is that relevant and can they enforce that? Has anyone gone through one with Revenue Canada?
My letter from RCA doesn’t say Net Worth, it just says Personal Tax Return from a certain period. Does that only pertain to what was filed? If so, can I refuse to provide the bank statements and credit card statements?

You have to produce any accounting, financial and tax records including bank statments and credit card statements that support your claims on your tax returns. If they think they are relevant to support your claims, but you refuse to produce them or have lost them or unable to produce duplicated copies, your expense or credit claims on your tax returns will be denied, or income increased. This authority is provided in the cdn income tax act.

If they tell you that they are doing a net worth audit on you, you will be asked to provide all documents showing your assets (savings account, chequing account, house, car, etc.), liabilities (credit cards, mortgage, loans, etc.), annual travel expenses, cash expenses, all sources of revenue or receipts, contents in your safety deposit box, etc.

ADDITIONAL COMMENTS re your additional details:
Sometimes, they dont tell you that it is a net worth audit. As it stands, whether a net worth audit or not, the CRA wants your bank statements to verify the the bank deposits (or revenue of your business), and distursements (expenses or expenditures), and the credit card statements to verify the expenses or expenditures. It appears that, based on the statements requested by the CRA, you are self employed or have a business, and as such, the bank statements and credit card stmts are the minimum financial records to support your business income or loss reported on your tax returns.

The info requested always relates directly or indirectly to what is filed or claimed or reported on your tax returns -your business operations. You cant refuse to produce them. If u do, they will demand them with a penalty warning. If you "lost" them, they will do a net worth on you, and that could be messy because the documents to be demanded from you would drive you nuts.

I missed my T4 copy for the FY2007 and have only employer’s T4 copy. Will I be able to tax file using the employer’s t4 copy. If not is there any other work around to do that. Kindly advice.

Thanks.

As long as the information written on it is correct, go ahead. If you want to confirm the amounts, contact the CRA, and ask them for a copy of it. The thing is that whenever you get a copy of a T4, your employer is REQUIRED to send a copy to the CRA so that they can verify what you are filing on your return.

I submitted my Income Tax Return Electronically. Revenue Canada reviewed and sent back a Notice of Assessment that I owed additional money.

I have no problem paying this amount. I am wondering, what just happend?

1) Did someone (a human being) review my return and determine that I owed more money, or was this done by computer?

2) Since I was re-assessed, (in general) does this mean i’m off the hook for an audit?

1) could have been an automatic recalculation (if you made a math error), or could have been a human checker who found something in error (non-math related, like a missed T4 or something). It should say on the notice what changed, though.

2) No, this makes no difference to the likelihood of an audit, could even raise it slightly, depending on what the problem was.

As a result of an audit I owe CRA 28000 dollars and we have arranged payment plan, do they usually report this to Equifax and Transunion bueraus?

I don’t believe so.

I’ve owed CRA money a few times over the last 10 years and entered into a payment plan and have never had it appear on my credit report.

They may have changed the rules recently but I thought there were confidentiality rules that prevented this sort of thing (plus they do have a bit of a monopoly on things, they’re eventually going to get your money).

Easiest way to be sure is to ask them.
